New website on the protection of messages in electronic communications

The Finnish Communications Regulatory Authority (FICORA) has published a consumer-targeted website giving advice on the secure use of electronic communications services on its website at www.ficora.fi. The site has useful information for all internet users and instructions on how to ensure confidentiality in communications. The site is particularly useful for consumers who need to protect or secure confidentiality in their communications.

Every Finnish citizen has the right to confidential electronic communications. This means that without a right prescribed under law or the consent of a party to the communication in question, no-one has the right to process another person’s messages or identification data related to communication.

Finnish legislation protects the confidentiality of communication services provided by Finnish telecoms companies, but the national legislation has limited possibilities to ensure the confidentiality of communications beyond Finland’s borders. The use of communications services located abroad involves new challenges in terms of maintaining the confidentiality of communications, for example because the legislation of some countries does not ensure the protection of the confidentiality of communications as well as Finland's legislation does.

Examples of foreign communications services favoured by consumers are the Gmail and Hotmail e-mail services and the Skype voice-over-internet protocol service. Even if the user language of a service is Finnish, this does not guarantee that the service is produced in Finland or that the processing of information complies with Finnish legislation.

The website, www.ficora.fi/viestinsuojaus/english, published and maintained by FICORA provides general information on the protection of communications. Internet service providers give further information on e.g. the protection of internet connections or encryption methods of e-mail services. The Finnish Federation for Telecommunications and Teleinformatics FiCom ry has participated in drafting the website.
